Easter Monday (April 6) will be added as a statutory holiday in 2026, and the number of statutory holidays will gradually increase to 17 days by 2030.
All employees are entitled to the aforementioned statutory holidays. If a statutory holiday falls on an employee's rest day, the employee shall take a compensatory day off on the following day.
The compensatory leave must not be a non-statutory holiday, a separately designated holiday, a substitute holiday, or a rest day. If an employee has been employed under a continuous contract for three months, they are entitled to holiday pay, the amount of which is equal to the employee's average daily wage for the 12 months preceding the holiday.
Reference example:
An employee's rest day is Sunday. Since the Chung Yeung Festival (October 18th) is a statutory holiday that falls on a Sunday, the employer should give the employee a compensatory day off the following day (i.e., October 19th). However, this day must not be a statutory holiday, a special holiday, a substitute holiday, or a rest day.
